Terms of Service

1. Scope and contracting party

These Terms of Service apply to your use of the "Abgehakt" app and of the optional additional features offered under the name "Abgehakt+". The provider and your contracting party for the provision of the app and its features is:

When you obtain Abgehakt+ as an in-app subscription, the purchase itself is concluded with the relevant app store operator (for the App Store: Apple Distribution International Ltd., Hollyhill Industrial Estate, Hollyhill, Cork, Ireland; for Google Play: Google Commerce Limited, 70 Sir John Rogerson's Quay, Dublin 2, D02R296, Ireland). Payment processing, invoicing and cancellation of the subscription are handled exclusively through that store. The provider named above remains your contracting party for the actual content of the Abgehakt+ service (unlocking the additional features).

Abgehakt+ can only be subscribed to in the iPhone/iPad app or the Android app. It cannot be subscribed to in the Mac app: the Mac app automatically recognizes an existing membership as soon as you sign in there with the same account you used to subscribe to Abgehakt+. Without Abgehakt+, all core features remain free to use on the Mac.

2. Description of the service

Abgehakt is a list app (shopping, tasks, recurring reminders and notes) for Android, iPhone/iPad and Mac. The basic features — creating and editing lists, reminders, notes, export and import — are free of charge forever and work locally on your device; you need neither an account nor a subscription for them. "Abgehakt+" unlocks the additional features in return for a recurring fee: sharing lists in real time, connecting devices via QR code, the home screen widget, and unlimited building blocks (keywords of your own that turn into several ready-made entries at once when you type them; without a membership you can create up to three). Sharing in real time, connecting via QR code and the home screen widget additionally require signing in with a Google or Apple account; building blocks work exclusively on your device and require no sign-in. Building blocks you have already created remain stored on your device and keep working even if your membership ends. How many people can jointly access shared lists depends on the plan you choose. The range of features may differ between platforms — for example, there is no home screen widget on the Mac.

Abgehakt+ applies to as many devices at the same time as your plan has seats. This limit is part of the scope you book. It exists so that a membership is not used beyond the scope booked and so that the running costs per plan remain predictable. It does not cause you any additional costs.

We will enforce this limit technically from 1 November 2026. If a device is added beyond the number of your seats after that date, the additional features will no longer be available on the device you have gone longest without using; as soon as you use that device again, it moves back in and another one gives way. Your lists remain on every device, and you can continue to use the basic features there free of charge. If you reinstall Abgehakt, the installation counts as a new device.

If you took out your membership before that date, we will only enforce the limit for you after informing you in advance on a durable medium about its characteristics and the date of the change. If this impairs your use more than insignificantly, you may end your membership free of charge within 30 days (Section 327r(2) to (4) of the German Civil Code, BGB).

If you pass on a seat from your plan to another person, that seat forms part of your membership and is tied to it. If your membership ends, the seat you passed on also ends, after a short transition period of a few days. The affected person keeps their lists and can continue to use Abgehakt free of charge; the additional features are then no longer available to them until they take out a membership of their own or receive a new seat.

We make every effort to keep the service available without interruption, but we cannot guarantee this (for example during maintenance or in the event of outages at third-party providers we use, such as Google Firebase or RevenueCat).

3. Your obligations regarding shared lists and sync groups

If you share lists or join sync groups, you undertake not to post unlawful content (including but not limited to insulting, defamatory or discriminatory content, or content that otherwise infringes applicable law) and not to misuse the feature (for example no automated bulk access and no attempt to circumvent security mechanisms).

Where there is reasonable suspicion of a breach of these rules, we may restrict or block the affected account's access to the sync and sharing features. This is without prejudice to any right to terminate for cause under Section 314 of the German Civil Code (BGB).

If you come across unlawful content in a shared list, you can report it to us informally at any time by e-mail to abgehakt@mlp3d.de. That address is also our point of contact under Articles 11 and 12 of Regulation (EU) 2022/2065 (Digital Services Act), for users and authorities alike; communication is possible in German and English. Please describe as precisely as you can which content is affected and why you consider it unlawful. We review every report promptly and inform you of the outcome.

4. Availability, data backup and liability

Despite careful technical safeguards (including encrypted local storage and automatic daily local backups, see the Privacy Policy), a total loss of data can never be ruled out, for instance in the event of device damage, operating errors or outages at third-party providers we use. We recommend that you additionally back up important list content yourself where needed (for example using the app's export function).

We are liable without limitation for intent and gross negligence, and under the provisions of the German Product Liability Act (Produkthaftungsgesetz). For slight negligence we are liable only where a material contractual obligation has been breached (a "cardinal obligation", meaning an obligation whose fulfilment is essential for the proper performance of the contract and on whose observance you may regularly rely); in that case liability is limited to the foreseeable damage typical for this type of contract.

Liability under the German Product Liability Act and for damage arising from injury to life, body or health remains unaffected by the above limitations of liability.

Where mandatory consumer protection law of the country in which you have your habitual residence provides for broader liability on our part, that law takes precedence over the limitations set out in this section.

5. Cancelling your Abgehakt+ membership

You cancel an Abgehakt+ subscription directly through the native subscription management of the relevant store (App Store or Google Play). You will find details in the app settings under "Manage subscription". Cancellation through the provider directly is not technically possible, because the contract for the purchase is concluded with the store. This applies regardless of the device you use Abgehakt on: even if you use Abgehakt+ on a Mac, you manage and cancel the subscription where you took it out (App Store or Google Play).

Your right to delete your user account and the associated cloud data in full at any time (see the Privacy Policy, "Delete account") remains unaffected. However, doing so does not automatically end an active paid subscription with the store.

6. Your statutory rights

These Terms of Service do not restrict your mandatory statutory rights as a consumer, in particular your rights under the national law implementing Directive (EU) 2019/770 on contracts for the supply of digital content and digital services (in Germany, Sections 327 et seq. BGB). Where these Terms of Service conflict with mandatory consumer protection law, the latter prevails.

7. Changes to these Terms of Service

We may amend these Terms of Service if the app, its features or the legal framework change. The current version is available in the app settings and on our support page.

8. Governing law and final provisions

German law applies. This choice of law does not, however, deprive you of the protection afforded to you by provisions of consumer protection law that cannot be derogated from by agreement under the law of the country in which you have your habitual residence (Article 6(2) of Regulation (EC) No 593/2008, "Rome I"). This applies to consumers resident in a Member State of the European Union as well as in Norway, Iceland and Liechtenstein. If you have your habitual residence in Switzerland, please note that under Article 120 of the Swiss Federal Act on Private International Law (PILA) a choice of law is excluded for consumer contracts, so that Swiss law applies to you.

Should any provision of these Terms of Service be invalid, the validity of the remaining provisions is unaffected.
